The District Court has made an important decision regarding land located on the Shankargarh hill in Shankargarh, Pal Nagar, Dewas. Rajneesh Agarwal, director of Messrs. RR Stone, filed civil suit number 74A/2021 against the District Magistrate and the Forest Department, requesting a stay order from the court, preventing the construction being carried out by the plaintiff and preventing the digging of pits for tree planting. The suit stated that this is the plaintiff’s land, located on the Shankargarh hill, and in the same area adjoining Palnagar, 200 meters below the hill, in survey number 414, the Forest Department owns valuable land on which tree planting has been and continues. The plaintiff had carried out illegal excavations and excavations on the said forest land, leading to a criminal case being filed against Rajneesh Agarwal under the Forest Act. It is noteworthy that the Forest Department was not initially made a party in this suit. Later, Government Advocate Mr. Manoj Shrivas requested permission from the Honorable Court to implead the Forest Department, which was granted. The government’s case was then effectively presented through testimony and witnesses. The court of learned Judge Mrs. Kiran Singh, after meticulously examining all the documents and the statements of witnesses from both sides, dismissed the plaintiff’s suit. The court’s decision conclusively demonstrates that illegal construction or management on Forest Department land cannot be protected. Government Advocate Manoj Shrivas effectively argued on behalf of the government, resulting in the court ruling in favor of the District Magistrate and the Forest Department. This decision is considered an important step toward protecting forest land and conserving the environment.
